Can Realtors Not Involved In A Transaction See The Names On A ...

Q: Can other Realtors, (not the buyer?s or not the seller?s Realtor) see the names of the parties on an AS IS Residential Contract For Sale And Purchase, while a property is under contract before it has closed, or do the parties names only become available to other Realtors after the contract has been closed?

A: Information on who the seller is can easily be found via public tax records, but information on who a prospective buyer is will not be disclosed to parties not directly involved in the transaction.

A: Only after it is closed unless the listing agent or selling agent disclosed confidential information to a third party without prior consent.

A: No, the information on contracts is private for the most part until the transaction closes and cannot be divulged without the permission of the parties. It is not customary for us to ask for this information from another brokers transaction and they are not obligated to provide it.

A: Great question!! In a nutshell: Absolutely not!! ONLY those parties whom are part of said contract: seller(s), buyer(s), seller?s agent and buyer?s agent are privy to any and all information contained in said contract- while still in escrow. I have never known an exception to be made in this regard! As you stated, once the transaction has settled- the information becomes public record: amount paid, date of settlement, and names of new owners- would all be part of the property?s tax record. Realtors may then see said information once your respective county has updated public records.
